2. Acceptance of Terms
By accessing and using our Service, you accept and agree to be bound by these Terms. If you do not agree to these Terms, you may not use our Service.
3. Description of Service
Amora.cards provides a digital platform that allows users to create, customize, and send physical postcards. Our service includes:
- Photo upload and editing tools
- Text customization and handwriting-style fonts
- Address management
- Professional printing on premium cardstock
- Worldwide shipping and delivery
4. User Account and Registration
To use our Service, you can create an account and must provide accurate, complete information. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized use
You must be at least 16 years old to use our Service. Users under 18 need parental consent.
You are responsible for ensuring that your use of our Service complies with all applicable local laws in your jurisdiction.
5. Orders and Payment
5.1 Order Process
When you place an order, you make a binding offer to purchase our services. We will send you an order confirmation via email, which constitutes our acceptance of your offer.
5.2 Pricing
All prices are clearly displayed on our website and include all applicable taxes and shipping costs. Prices may change without notice, but will not affect orders already placed.
5.3 Payment
Payment is processed through Stripe and is due immediately upon order placement. We accept major credit cards and other payment methods as displayed during checkout.
We do not store or process your full payment card information on our servers.
Your payment details are handled directly by Stripe. Please refer to Stripe's privacy policy for more information.
6. Right of Withdrawal (EU Consumer Rights)
According to Article 16(c) of the EU Consumer Rights Directive, the right of withdrawal does not apply to contracts for the supply of goods that are made to the consumer's specifications or are clearly personalized.
Since all of our postcards are custom printed with your uploaded photos, messages, and recipient details, they are considered personalized goods. Therefore, no right of withdrawal exists once the order has been placed and production has begun.
If you believe there has been an error or issue with your order (e.g., print quality defect), please contact us within 30 days and we will be happy to assist you (see Section 10).
7. Content Guidelines and Restrictions
You are solely responsible for the content you upload and send through our Service. Prohibited content includes:
- Illegal, harmful, or offensive material
- Content that violates intellectual property rights
- Spam, harassment, or threatening messages
- Adult content or material inappropriate for general audiences
- Political or religious propaganda
- Content that violates applicable laws or regulations
We reserve the right to refuse or cancel orders containing prohibited content.
8. Intellectual Property
You retain ownership of the content you upload. By using our Service, you grant us a limited license to reproduce, print, and deliver your content for the purpose of fulfilling your order.
Our website, design, logos, and service marks are protected by intellectual property laws and remain our exclusive property.
9. Delivery and Performance
9.1 Processing Time
Orders are typically processed within 1-2 business days after payment confirmation.
9.2 Shipping
Delivery times vary by destination:
- Europe: 3-7 business days
- North America: 5-10 business days
- Rest of World: 7-15 business days
Delivery times are estimates and may vary due to postal service delays or other factors beyond our control.
9.3 Risk of Loss
Risk of loss transfers to you once the postcard has been handed over to the postal service for delivery to the recipient. We are not responsible for delivery delays or loss caused by postal services unless due to our fault.
10. Warranty and Defects
We warrant that our postcards will be printed to professional standards. If you receive a defective product, please contact us within 30 days of delivery. Please include photos or a description of the defect when contacting us about a problem. We will, at our discretion:
- Reprint and resend the postcard
- Provide a full refund
This warranty does not cover issues related to postal service handling or delivery delays.
11. Limitation of Liability
Nothing in these Terms shall exclude or limit liability where it would be unlawful to do so. In particular, this limitation does not apply to damages resulting from injury to life, body, or health, or to liability under the German Product Liability Act (Produkthaftungsgesetz).
For German consumers, we are liable without limitation for damages caused by gross negligence, intent, or breach of essential contractual obligations (Kardinalpflichten).
12. Force Majeure
We are not liable for delays or failures in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, government actions, strikes, or technical failures.
13. Privacy and Data Protection
Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.
14. Termination
We may terminate or suspend your account at any time for violation of these Terms. Upon termination, your right to use the Service ceases immediately.
15. Governing Law and Jurisdiction
If you are a consumer in the EU, the law of your country of residence applies, and you may bring legal proceedings in your local courts. For business users or non-EU consumers, German law applies and the courts of Rheine, Germany have exclusive jurisdiction.
